1. Acceptance of Terms

By accessing or using Kubiq Network, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

Kubiq Network is a social network platform that allows users to share content, follow other users, and participate in discussions.

3. User Account

To use certain features of our service, you must create an account. You are responsible for maintaining the confidentiality of your account and password, as well as for all activities that occur under your account.

4. User Content

You are solely responsible for the content you post on Kubiq Network. You grant Kubiq Network a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content.

5. User Behavior

You agree not to use our service to:

Post illegal, offensive, abusive, or harmful content
Harass, intimidate, or discriminate against other users
Impersonate another person
Collect information about other users without their consent
Interfere with the proper functioning of the service

6. Intellectual Property

Kubiq Network and its original content, features, and functionality are and will remain the exclusive property of Kubiq Network and its licensors.

7. Termination

We reserve the right to terminate or suspend your account and access to the service without notice if you violate these terms.

8. Limitation of Liability

Kubiq Network will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any significant changes.

10. Governing Law

These terms are governed by French law, regardless of conflict of law principles.

11. Shop & Marketplace Feature

Kubiq Network allows users to open an online shop - Kubiq Shop - to sell products directly through the platform. As a technical intermediary, Kubiq Network is not a party to the sales contract between the seller and the buyer.

Each seller is an independent entity, responsible for their products, their legal compliance, and order fulfillment.
Kubiq Network reserves the right to validate, suspend or remove any shop that does not comply with these Terms or applicable law.
Opening a shop requires a valid SIRET number and approval from the Kubiq team.

12. Payment Processing — Stripe

Payments made on Kubiq shops are processed by Stripe, Inc., a third-party payment service provider. By making a purchase, you agree to Stripe's Terms of Service available at stripe.com/legal.

Kubiq Network uses Stripe Connect to distribute funds to sellers. A service fee may be charged by Kubiq Network on each transaction, in accordance with the applicable pricing policy. Kubiq Network never has direct access to the complete banking information of buyers or sellers.

In the event of a payment dispute or anomaly, the buyer should first contact the seller. If no agreement is reached, Stripe can be contacted via its chargeback system. Kubiq Network may act as a facilitator, without being held liable.

13. Seller Responsibilities

By opening a shop on Kubiq Network, the seller agrees to:

Provide accurate product information (description, price, availability, shipping times).
Comply with applicable French and European law regarding distance selling (right of withdrawal, legal conformity guarantee, etc.).
Fulfill all orders placed through the platform and promptly inform buyers of any issues.
Not list illegal, counterfeit, dangerous, or intellectual property-infringing products.
Connect and keep active their Stripe account to enable payment receipt. Any issues related to the Stripe account are the exclusive responsibility of the seller.

14. Buyer Responsibilities

By making a purchase on a Kubiq shop, the buyer acknowledges that:

The sales contract is concluded directly with the seller (the Kubiq shop), not with Kubiq Network.
The buyer has a 14-day right of withdrawal from receipt of the product, in accordance with consumer law, subject to legal exceptions.
Any product complaint (non-conformity, non-receipt) should first be addressed to the seller via Kubiq messaging.
Payment information is transmitted directly to Stripe and is never stored on Kubiq Network's servers.

15. Disputes & Refunds

In the event of a dispute between a buyer and a seller, Kubiq Network may intervene as a mediator on a goodwill basis, without legal obligation. To initiate mediation, contact Kubiq support at the address provided in the legal notice.

Refunds are processed by Stripe at the seller's request or, in the case of a recognized dispute, at Stripe's initiative. Kubiq Network cannot be held responsible for the timing or conditions of refunds decided by Stripe.

16. Kubiq communities

Communities are spaces created and operated by users or third-party organizations. Kubiq Network provides technical infrastructure (posts, members, events, messaging) without being the organizer of activities within each community.

The community administrator is solely responsible for published content, internal rules, moderation, and compliance with applicable law.
Joining a community does not create a direct contractual relationship between the member and Kubiq Network for activities organized by that community.
Kubiq Network may suspend or remove a community in case of breach of these Terms, substantiated reports, or authority requests.
Data related to a community (posts, event registrations, etc.) is processed in accordance with the privacy policy and the organizer's choices.

17. Fundraising and HelloAsso

Some communities may offer fundraising or donation campaigns via HelloAsso integration. HelloAsso is an independent third-party provider; Kubiq Network is neither the publisher of campaigns nor the recipient of collected funds.

Any financial transaction via HelloAsso is governed by HelloAsso's terms and privacy policy (helloasso.com).
The campaign organizer is responsible for use of funds, legal compliance, and information provided to donors.
Kubiq Network is not liable for delays, refusals, disputes, or payment issues processed by HelloAsso.
Users should verify the organizer's identity and the purpose of a campaign before donating.

18. Events and registrations

Events on Kubiq may be free or paid. When a paid event links to external ticketing, Kubiq does not collect payment and does not issue tickets on behalf of the organizer.

Registering on Kubiq may express interest, receive information, or a reminder, without confirming paid participation when external payment is required.
The organizer sets prices and the ticketing link; users must follow it to obtain a confirmed, paid spot.
Integrated event payment on Kubiq may be offered later; until then, only links or methods indicated by the organizer apply.
Refunds, cancellations, and disputes regarding an event are handled primarily with the organizer.
Kubiq Network may send reminder or technical confirmation emails; they do not replace a ticket issued by the organizer's ticketing system.
The organizer is responsible for safety rules, capacity, and legal obligations related to their event.
